Is Release Still Possible After Arrest in China?

Yes. Arrest is not the end of the road. In China, "arrest" (逮捕) means that the procuratorate, the state prosecution authority, has approved continued custody, usually for months while the case proceeds. But the arrested person, their legal representative, their close relatives and their lawyer can all apply to change the coercive measure: the term Chinese law uses for custody and its alternatives, such as release on bail (取保候审) or residential surveillance (监视居住).

The procuratorate also has a continuing duty to review whether custody is still necessary, and must recommend release or a change of measure when it is not. Whether a change is granted depends on the facts: health, the progress of the case, admission of guilt, compensation to victims and similar factors.

What routes does the law provide?

Route Who can apply To whom Deadline for the authority
Application to change the coercive measure The person, their legal representative, close relatives, defense lawyer The police, procuratorate or court currently handling the case Decision within 3 days; if refused, the applicant must be told the reasons
Application for review of the necessity of custody The person, their legal representative, close relatives, defense lawyer, duty lawyer The procuratorate corresponding to the authority handling the case During investigation or trial, within 10 days the procuratorate decides whether to recommend release or a change to the police or court; at the prosecution review stage, the procuratorate decides on a change application within 3 days
Review by the procuratorate on its own initiative — — The procuratorate must keep reviewing the need for custody. For suspects in custody who may receive three years or less and whose custody has not been reviewed at the prosecution review stage, it must review once before charging
Expiry of time limits The person, their legal representative, close relatives, defense lawyer The authority handling the case When the legal custody period expires, the person must be released or the measure changed; if the case cannot be finished in time, the person must be released, and bail or residential surveillance may be used if further investigation or trial is needed

When the police carry out an arrest, they must tell the arrested person of the right to apply for a change of measure and to ask the procuratorate for a review of the necessity of custody.

A duty lawyer (值班律师) is a legal aid lawyer stationed at courts and detention centers to give basic legal help to people who have not appointed their own lawyer. A duty lawyer's role is limited; they do not conduct a full defense.

When is a change more likely?

The rules set out three tiers. Separately, if the person is found to be seriously ill, pregnant or breastfeeding, the only carer for a minor or for someone unable to care for themselves, or if the evidence or facts change significantly, the procuratorate and police must start a review immediately.

Tier 1: Release or a change of measure is required where:

  • the evidence changes significantly, so that there is no evidence of a crime or the crime was not committed by this person;
  • the facts, circumstances, law or judicial interpretations change, so that the person may receive only short-term detention or public surveillance, a supplementary penalty alone, exemption from punishment, or an acquittal;
  • continued custody would exceed the sentence the person could lawfully receive;
  • the facts have essentially been established, the evidence has been collected and secured, and the conditions for bail or residential surveillance are met; or
  • custody is otherwise inappropriate.

Tier 2: Release or a change of measure is possible where the person shows remorse, release would not create a danger to society, and, for example:

the offense was only prepared or was abandoned; the person is a first offender with low culpability; they were an accessory or acted under coercion; the offense was negligent; they exceeded the limits of self-defense or necessity; they have admitted guilt and accepted punishment; they have settled with or been forgiven by the victim; they have paid compensation in full or in part, or provided security for it; they are seriously ill or cannot care for themselves; they are pregnant or breastfeeding; they are a minor or aged 75 or over; they are the only carer for a minor or for someone who cannot care for themselves; or they are likely to be sentenced to one year or less, or to receive a suspended sentence.

Tier 3: A change is generally not granted where the person is suspected of national security offenses, terrorism, organized crime, major drug offenses or other offenses seriously endangering society, or serious violent crime; faces ten years or more; was arrested for breaching bail or residential surveillance conditions; may destroy or fabricate evidence, interfere with witnesses or collude with others; may retaliate against the victim, an informant or a complainant; or has tried to commit suicide or escape. However, even in these cases, a change to residential surveillance or bail is still possible where the person is seriously ill or there are other special circumstances that make continued custody unsuitable, and release would not create a danger to society.

What should the application include?

The application must explain why continued custody is unnecessary, with supporting evidence or materials where available. Common materials include:

  • Health: hospital diagnoses, medical records, test results, and where necessary an assessment by a qualified institution. Medical records from abroad should be translated, and the lawyer will advise whether notarization is needed.
  • Family: proof of dependants the person supports.
  • Progress of the case: that the facts are essentially established, the evidence has been secured, or the evidence or charge has changed. The lawyer usually prepares this from the case file or what the authorities have disclosed.
  • Admission of guilt, compensation, forgiveness or settlement: agreements, receipts, letters of forgiveness and transfer records.
  • Stability of residence, work and family: proof of residence, employment contract and social insurance records. For a foreign national, a residence permit, a lease or employer's letter, and someone able to act as guarantor or the means to pay a deposit are usually relevant. What do the authorities look at?

The review takes into account the suspected offense and its circumstances, the likely sentence, the stage of the case and how far the evidence has been collected, whether the person's statements are consistent, any prior record, how the person came into custody, whether accomplices are still at large, any risk of collusion, mitigating factors such as admission of guilt, voluntary surrender, confession, restitution and forgiveness, health, conduct in custody, and whether the conditions for bail or residential surveillance are met.

So the same reason can lead to different outcomes in different cases. Illness, for example, is weighed according to how serious it is, whether it can be treated in the detention center, the offense and the state of the evidence.

What if the application is refused?

  1. Read the reasons. An authority that refuses must give reasons, and the next application should respond to them.
  2. Reapply only with something new. If the authority has found custody necessary and the applicant reapplies without new evidence or new reasons, it may decline to review again. Do not resubmit the same materials.
  3. Watch the deadlines. If the investigation custody period is extended or recalculated, or the case is sent back for supplementary investigation and custody is extended as a result, the limit above does not apply and a new application can be made.
  4. Challenge unlawful or overdue custody. If a coercive measure is not lifted or changed when its legal time limit expires, the person, their lawyer or an interested party can petition or complain to that authority, and, if dissatisfied with the response, petition the procuratorate at the same level.

What should you know after a change?

  • Bail does not end the case. Bail can last up to 12 months and residential surveillance up to 6 months, and the investigation, prosecution and trial continue in the meantime. Once the case moves to the procuratorate or the court, each can issue a new bail decision, so bail often spans several stages.
  • Follow the bail conditions. Do not leave the city or county without approval; report any change of address, job or contact details within 24 hours; attend when summoned; do not interfere with witnesses or destroy, fabricate or coordinate evidence. Serious breaches can lead to arrest and forfeiture of the deposit.
  • The authority may also bar the person from certain places, from meeting or contacting certain people, or from certain activities, and may hold their passport. A foreign national cannot leave China while the case is pending.
  • Criminal Procedure Law of the People's Republic of China, Articles 67 to 71, 79, 81, 95 to 99, 117, 156 and 158
  • Provisions on the Review and Assessment of the Necessity of Custody (Supreme People's Procuratorate and Ministry of Public Security, issued November 30, 2023), Articles 1, 5 to 9, 12, and 16 to 19
